- Payment
3.1 Fees: The fees for the Services will be as agreed upon between Ajay Kajla and the client. The client shall make the payment in the manner specified by Ajay Kajla. Unless otherwise agreed, all fees are non-refundable.
3.2 Taxes: The client shall be responsible for paying any applicable taxes, including but not limited to Goods and Services Tax (GST), as per the prevailing laws of India.
- Intellectual Property
4.1 Ownership: Unless otherwise agreed in writing, Ajay Kajla retains ownership of all intellectual property rights in the deliverables and materials created during the provision of the Services, including but not limited to web designs, code, graphics, and digital content.
4.2 License: Upon receipt of full payment, Ajay Kajla grants the client a non-exclusive, non-transferable license to use the deliverables solely for the purpose specified in the agreed project scope. The client may not modify, reproduce, or distribute the deliverables without prior written consent from Ajay Kajla.
- Confidentiality
Both parties agree to keep any confidential information shared during the provision of the Services confidential and not disclose it to any third party without prior written consent, except as required by law.
- Limitation of Liability
To the fullest extent permitted by law, Ajay Kajla shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with the use or inability to use the Services, including but not limited to loss of data, loss of business, or loss of profits.
- Dispute Resolution
In the event of any dispute arising from or relating to this Agreement, the parties shall make reasonable efforts to resolve it amicably through negotiations. If the dispute remains unresolved, it shall be referred to arbitration in accordance with the laws of India.
- Governing Law
This Agreement shall be governed by and construed in accordance with the laws of India. The courts of India shall have exclusive jurisdiction over any disputes arising from this Agreement.
- Modifications
Ajay Kajla reserves the right to modify or update these Terms & Conditions at any time without prior notice. It is your responsibility to review this Agreement periodically for any changes.
By using the Services provided by Ajay Kajla, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.
